1. Acceptance of Terms

By accessing or using Buscando Bachata ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

2. Description of Service

Buscando Bachata is a platform that helps bachata dancers discover:

• Local dance classes and workshops
• Social dancing events and festivals
• Bachata artists and instructors
• Personalized event notifications based on location

We aggregate event information from various sources including social media and partner organizations. We strive for accuracy but cannot guarantee that all information is current or complete.

We also provide ticketing services for event organizers and subscription-based notification pipeline services for community curators.

3. Platform Role

Buscando Bachata acts as a marketplace facilitator, connecting event organizers with attendees and providing tools to manage ticket sales. We are NOT the organizer or host of events listed on the platform.

• Ticket purchases are transactions between you and the event organizer
• Refund policies are set by each organizer and displayed at the time of purchase
• Buscando Bachata facilitates payment processing but does not hold ticket sale funds
• Event organizers are solely responsible for the event experience

4. Fees and Payments

Ticketing Fees

A platform fee of $0.89 per ticket is applied to each ticket purchase. This fee covers payment processing, QR code generation, and platform infrastructure. A portion of each platform fee ($0.05) is contributed to the Dance Education Fund.

Subscription Plans

Organizers may subscribe to pipeline plans for branded notification services:

• Starter: $25/month or $240/year (up to 2,500 subscribers, 10 sources)
• Pro: $50/month or $480/year (unlimited subscribers, white-label, custom domain)

Subscriptions may include a free trial period. You will be charged at the end of the trial unless you cancel before it expires. Subscription management is available through the Stripe Customer Portal.

5. Organizer Responsibilities

If you register as an event organizer on our platform, you agree to:

• Provide accurate event information including dates, times, and venues
• Fulfill ticket purchases and honor the events as described
• Set and comply with your stated refund policy
• Process refunds in a timely manner when applicable
• Comply with all applicable local laws regarding events and ticketing
• Maintain an active Stripe Connect account for payment processing
• Not list events that are fraudulent, misleading, or illegal

6. Refund Policies

Refund policies for ticket purchases are determined by each event organizer. The applicable refund policy is displayed during checkout and confirmed in your order receipt. Buscando Bachata facilitates refund processing but the organizer sets the terms.

In the event of an event cancellation by the organizer, all ticket holders will receive a full refund processed through the original payment method.

7. User Accounts and Subscriptions

When you subscribe to our notification service, you agree to:

• Provide accurate and current information
• Maintain the security of your email address
• Accept responsibility for all activities under your subscription
• Notify us of any unauthorized use

You may unsubscribe from notifications at any time using the unsubscribe link in our emails or by visiting the preferences page.

8. User-Generated Content

If you submit content to our platform (such as reviews, feedback, or event information), you:

• Grant us a non-exclusive, royalty-free license to use, display, and distribute your content
• Represent that you own or have the right to submit such content
• Agree not to submit content that is unlawful, offensive, or infringes on others' rights
• Acknowledge that we may remove content that violates these Terms

We reserve the right to moderate, edit, or remove any user-generated content at our discretion.

9. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Scrape, crawl, or automatically collect data from our site without permission
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity
• Upload viruses or malicious code
• Violate any applicable laws or regulations

10. Event Information Disclaimer

Before attending any event, we strongly recommend:

• Verifying event details directly with the organizer
• Checking the official event page or social media
• Confirming dates, times, and locations
• Reviewing any event-specific terms and conditions

Buscando Bachata is not the organizer of listed events and is not responsible for event cancellations, changes, or any issues arising from attending events.

11. Intellectual Property

The Service and its original content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code

Event flyers and promotional images are the property of their respective organizers and are displayed for informational purposes only.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us (if any) in the past 12 months

13. Indemnification

You agree to indemnify and hold harmless Buscando Bachata, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Third-Party Links

Our Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your use by unsubscribing from notifications and ceasing to use the website.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of California.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
